Terms of Service

1. Parties

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer") and DESFECHO RELEVANTE UNIPESSOAL LDA, a company incorporated under Portuguese law (NIF: 516 949 160, VAT: PT516949160), with its registered office at Rua da Liberdade, n.º 47, Loja B, 8400-369 Lagoa, Faro, Portugal ("Company", "we", "us").

The Company operates the cloud infrastructure platform accessible at kube-dc.cloud under the brand name Kube-DC.cloud.

2. Acceptance of Terms

By accessing or using Kube-DC.cloud services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services. Use of our services by an entity constitutes acceptance on behalf of that entity.

3. Description of Service

Kube-DC.cloud provides Kubernetes-native cloud infrastructure services, including but not limited to: virtual machines, container orchestration, managed Kubernetes clusters, managed databases (PostgreSQL, MariaDB), S3-compatible object storage, SDN networking, and related developer tools. Service availability and features may change over time.

4. Account Registration

To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at [email protected].

5. Acceptable Use

You agree not to use our services for any unlawful purposes or in any way that could damage, disable, or impair our services. Prohibited activities include:

• Cryptocurrency mining without explicit written permission
• Distributing malware or conducting cyberattacks
• Hosting illegal content under Portuguese or EU law
• Violating intellectual property rights
• Reselling services without prior written authorization
• Generating excessive load that degrades service for other users

6. Payment Terms

Subscription fees are billed monthly in advance. All fees are non-refundable unless otherwise stated in writing. We reserve the right to modify pricing with at least 30 days' notice. Billing inquiries should be directed to [email protected]. Applicable VAT (PT516949160) will be charged where required by law.

7. Service Level Agreement

We strive to maintain 99.9% uptime for our services. Scheduled maintenance windows will be communicated at least 48 hours in advance. Service credits may be available for extended unplanned outages as per our SLA policy, available upon request.

8. Data and Security

You retain full ownership of all data you store on our platform. We implement industry-standard security measures but cannot guarantee absolute security. You are solely responsible for maintaining backups of your data. Our data processing practices are described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable Portuguese and EU law, DESFECHO RELEVANTE UNIPESSOAL LDA shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total aggregate liability shall not exceed the fees paid by you in the three months preceding the claim.

10. Termination

Either party may terminate this agreement at any time with written notice. Upon termination, your access to services will be revoked. Your data will be retained for a 30-day grace period, after which it may be permanently deleted. We may suspend or terminate accounts immediately for violations of these Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of Portugal and applicable European Union regulations. Any disputes shall be subject to the exclusive jurisdiction of the courts of Faro, Portugal, without prejudice to mandatory consumer protection rights under EU law.
